Determination Of Child Support

Child support is dictated by the Illinois Child Support Guidelines, which takes into account each party's income and their respective parenting time.  Other factors that may affect a party's income for purposes of determining child support may include, but are not limited to:


  • Unreported income from a self-employed parent
  • Imputed income for an unemployed or underemployed parent
  • Big fluctuations in month-to-month income
  • High income earners
  • Special needs of the child(ren)

Will There Be Maintenance (Alimony)?

In Illinois, spousal support is referred to as maintenance (rather than alimony).  Like child support, maintenance is largely determined by statutory guidelines. If a party is found to be entitled to maintenance, the amount is generally based on both parties’ respective incomes and the length of the marriage. Courts also consider additional factors, such as each party’s age, employment history, education, and present and future earning capacity.
